Terms of Service

1. General

1.1. These Terms of Service ("Terms") govern the relationship between NeuroFans ("Platform", "we", "us") and each user ("User", "you"). The Platform provides services for creating, storing, and distributing digital content using artificial-intelligence technology.

1.2. By creating an account or accessing any part of the Platform you agree to these Terms in full, without modification.

1.3. Users who create, publish, or sell content on the Platform are additionally referred to as "Creators". Fans who consume or purchase content are referred to as "Fans". Both are subject to these Terms.

2. Age Restrictions & Eligibility

2.1. The Platform is intended exclusively for persons who are at least 18 years old (or 21 years old in jurisdictions where that is the legal minimum for adult content).

2.2. By registering you declare, under penalty of applicable criminal law, that you meet the minimum age requirement in your jurisdiction.

2.3. We reserve the right at any time to request government-issued photo ID (passport, driving licence, or equivalent) to verify age. You must provide the requested documents within 72 hours of the request.

2.4. Refusal to provide documents within 72 hours results in immediate account suspension without refund.

2.5. Any attempt to circumvent age restrictions — including using false documents, someone else's identity, or VPN to mask jurisdiction — results in immediate permanent ban and referral to relevant law-enforcement authorities.

3. Prohibited Content (Absolute Ban)

The following is strictly prohibited from being created, uploaded, distributed, requested, or generated on the Platform (including in text prompts, images, video, audio, and chat messages):

• Minors in sexual context — any sexual context involving persons under 18 years of age, including hints, role-play ("schoolgirl", "teen", "barely legal", "18 yesterday"), anime aesthetics with minor-indicating characteristics, or any character appearing or behaving as a minor.
• Bestiality — any sexual context involving animals, whether real or fictional anthropomorphic characters with clear animal features.
• Necrophilia — sexual context involving dead bodies or characters presented as deceased.
• Non-consensual violence — torture, rape, or content depicting harm without the explicit documented consent of all parties.
• Incest — even in role-play format, including "step" relationships (step-sister, step-mom, step-dad) or any content implying family ties.
• Unauthorised deepfakes — creating or distributing content depicting real persons (including celebrities, politicians, or private individuals) without their written, verifiable consent.
• Non-consensual intimate imagery (NCII) — any material created or shared without the depicted person's consent.
• Extremist / terrorist content — glorification of or incitement to violence, racial, religious, or national hatred, or terrorism.
• Suicide / self-harm promotion — content that promotes, glamorises, or instructs on suicide, self-harm, or eating disorders.
• Illegal drug promotion — content that promotes or depicts the use of controlled substances.
• Fraud and phishing — any attempt to deceive other users, collect credentials, or engage in financial fraud.
• Copyright infringement — uploading material you do not own or lack a licence for.

4. Creator Responsibilities

4.1. You own, or hold all necessary rights and licences to, every piece of content you upload or generate.

4.2. All depicted persons in any content you upload or generate are at least 18 years old at the time of creation.

4.3. You are solely responsible for any taxes on your earnings from the Platform.

4.4. Creators must complete identity and age verification (KYC) via our verification partner before publishing any content. US federal law (18 U.S.C. §2257) requires that age-and-identity records for every depicted person be maintained for a minimum of seven years.

4.5. You consent to content you publish being visible to subscribers in accordance with your chosen privacy settings.

5. Platform Fees

5.1. NeuroFans charges a flat 10% platform fee on all transactions (subscriptions, tips, pay-per-view). Creators retain 90% of earnings.

5.2. Founding Creators (first 50 verified creators) receive 0% commission for their first calendar month, as described in the Founding Creators Terms.

6. Payments & Payouts

6.1. Payments are processed via NOWPayments (crypto: USDT, BTC, and others) and Paxum.

6.2. Payouts are subject to a minimum balance threshold and are typically processed within 24 hours of a valid request.

6.3. Refunds are governed by the Refund Policy.

7. Intellectual Property

7.1. All rights to content you generate on or upload to the Platform remain yours, unless otherwise agreed in a separate written instrument.

7.2. You grant NeuroFans a perpetual, revocable, non-exclusive, royalty-free licence to use, display, and process your content solely for the purposes of: operating and moderating the Platform; improving AI models (in anonymised form); and complying with legal obligations.

7.3. You guarantee that any material you upload does not infringe any third party's intellectual property, privacy, or other rights. You bear full legal and financial liability for any such infringement.

8. Limitation of Liability

8.1. The Platform acts solely as a technical intermediary and is not responsible for content created by Users, including AI-generated content produced using Platform tools.

8.2. The Platform does not guarantee uninterrupted service and reserves the right to change features, design, or availability without prior notice.

8.3. The Platform is not liable for any direct, indirect, incidental, punitive, or consequential damages — including loss of data, lost profit, or reputational harm — arising from use of or inability to use the service.

8.4. Our maximum aggregate liability to you is limited to the amounts you paid to us in the three months preceding the claim, but in no event more than USD $100 (or equivalent).

8.5. We are not liable for acts of third parties including hackers, other users, or payment providers.

9. Account Suspension & Termination

9.1. We may suspend or permanently ban any account at any time, without notice or explanation, if, in our sole discretion, the User's activity violates these Terms or harms the Platform, other users, or third parties.

9.2. Suspension for prohibited-content violation: no refund.

9.3. You may delete your account at any time via account settings or by contacting support@neuro-fans.com. Account deletion does not entitle you to a refund for any unused period.

10. Privacy

Use of the Platform is governed by our Privacy Policy, which forms an integral part of these Terms. By registering you consent to the processing of your personal data as described therein.

11. Changes to Terms

11.1. We may update these Terms at any time. Continued use of the Platform after an update constitutes acceptance of the revised Terms.

11.2. The current version is always available at /legal/terms.

12. Governing Law & Dispute Resolution

12.1. These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the operating entity is incorporated. The Platform will publish its registration details at this page once the legal entity is established.

12.2. Before initiating any formal proceeding, the parties must attempt good-faith negotiation by sending a written claim to support@neuro-fans.com. The pre-dispute period is 30 calendar days from receipt of the claim.

12.3. If no resolution is reached, the dispute shall be finally resolved by binding arbitration conducted in the English language under internationally recognised arbitration rules. The award shall be final and enforceable in any court of competent jurisdiction.

12.4. CLASS-ACTION WAIVER: You waive any right to participate in a class-action lawsuit or class-wide arbitration against the Platform. All claims must be brought individually.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, Acceptable Use Policy, Refund Policy, and any other policies linked herein, constitute the entire agreement between you and NeuroFans.
